In order to use the property, facilities, and services of Piedmont eBikes (eBikes) located at 901 N Trade Street, Winston-Salem, NC 27101, I agree for myself and (if applicable) for the members of my family, to the following:
I hereby request to test ride or rent an electric bicycle from Piedmont eBikes. I acknowledge that North Carolina law does not require that a bicycle helmet be worn when riding an electric bicycle, however, Piedmont eBikes requires wearing a bicycle helmet at all times when on a Piedmont eBike demo or rental eBike. I acknowledge that I am 18 years of age or older, will wear a helmet and will obey the local bike laws.
I understand and accept that riding this electric bike and participating in biking exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in bicycling. I choose to participate in bicycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bicycle and participating in bicycling.
I agree to ride the eBike in compliance with all traffic laws and will exercise care to ensure the safe operation of the bicycle. I agree not to perform stunts, or to attempt any “trick” riding during the test drive or rental.
Rider agrees to return the eBike to Piedmont eBikes in the same condition as received, except for ordinary wear and tear, on the time and at the location specified by Piedmont eBikes.
Rider shall pay Piedmont eBikes for all losses and/or damage to the eBike, regardless of fault (e.g. Rider agrees to pay for the loss even though someone else caused the damage or is at fault). Rider is also responsible for all theft or vandalism losses, even if Rider is not at fault for making the theft or vandalism possible. If the eBike is damaged, Rider agrees to pay the reasonable costs of repair or the retail fair market value less any salvage value if applicable.
In consideration for being premised by Piedmont eBikes to rent or ride an electric bike, I promise to indemnify, hold harmless, and defend Piedmont eBikes against any and all claims to which this agreement applies, including claims for their own negligence, as well as apply this indemnification clause to any loss or personal injury to any third party resulting from my participation in any use of Piedmont eBikes demo or rented eBikes.
I have carefully read and understand the above. I understand this is an assumption of risk, waiver and release of liability and I sign it voluntarily. I also understand that I should not and may not participate in this activity if I am under the influence of alcohol or drugs.
I also agree to receive emails or texts with the latest information and discounts from Piedmont eBikes.
